3. DISPUTE RESOLUTION AND BINDING ARBITRATION
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
3.1 Agreement to Arbitrate
You and 3dprintingandmodeling.com mutually agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of this Website, or any products or services obtained through this Website (collectively, “Disputes”) shall be resolved exclusively through final and binding arbitration, rather than in court, except as set forth below.
This agreement to arbitrate is intended to be broadly interpreted and includes, but is not limited to:
- Claims arising out of or relating to any aspect of the relationship between us;
- Claims that arose before these Terms or any prior agreement;
- Claims that may arise after termination of these Terms;
- Claims related to accessibility of this Website.
3.2 Arbitration Rules and Procedures
Arbitration shall be administered according to the following procedures, designed to provide a fair and cost-effective resolution:
(a) Arbitration Provider. Arbitration shall be conducted through one of the following, in order of preference based on availability and mutual agreement:
- Small Claims Court – If your claim (or our counterclaim) is within the jurisdictional limits of small claims court in Allegheny County, Pennsylvania, either party may elect to resolve the dispute in small claims court rather than through arbitration;
- American Arbitration Association (AAA) Consumer Arbitration Rules – Using AAA’s Consumer Arbitration Rules, which provide reduced fees for consumer disputes (information available at www.adr.org);
- Single neutral arbitrator mutually agreed upon by both parties, who shall be a licensed attorney or retired judge with experience in internet or business disputes;
- Court-appointed arbitrator – If the parties cannot agree on an arbitrator within 30 days of a demand for arbitration, either party may petition the state court in Allegheny County, Pennsylvania to appoint a neutral arbitrator.
(b) Simplified Procedures for Claims Under $10,000. For any dispute where the total amount in controversy is less than $10,000 (excluding attorneys’ fees and costs):
- The arbitration shall be conducted entirely through submission of documents and written statements, without an in-person hearing, unless either party requests a hearing or the arbitrator determines one is necessary;
- Each party shall submit a written statement of their position, supporting documents, and proposed resolution within 30 days of arbitrator appointment;
- The arbitrator shall render a decision within 30 days of receiving both parties’ submissions;
- The arbitrator’s fee shall be split equally between the parties, unless the arbitrator determines that such allocation would be cost-prohibitive to one party.
(c) Arbitration Location. Any in-person arbitration hearing shall take place in Allegheny County, Pennsylvania. However, for your convenience, you may elect to participate by telephone or video conference if such options are available.
(d) Arbitrator Authority. The arbitrator shall have the authority to award any remedy that would be available in court, provided such remedy is consistent with these Terms.
3.3 Exceptions to Arbitration
Notwithstanding the foregoing, either party may:
- Bring an individual action in small claims court if the claim qualifies for small claims court jurisdiction in either your county of residence or Allegheny County, Pennsylvania.
- Seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights;
- Seek injunctive relief in court regarding accessibility, provided that monetary claims shall remain subject to arbitration.
3.4 Class Action and Jury Trial Waiver
YOU AND 3DPRINTINGANDMODELING.COM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.
Unless both you and we agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class, collective, or representative proceeding.
YOU HEREBY WAIVE ANY RIGHT TO A JURY TRIAL FOR ANY DISPUTE SUBJECT TO ARBITRATION UNDER THESE TERMS.
3.5 Arbitration Costs
(a) Filing Fees. If you initiate arbitration, you shall be responsible for paying the initial filing fee required by the arbitration provider, except as provided below. If we initiate arbitration, we shall pay the initial filing fee.
(b) Cost Hardship. If you believe that the costs of arbitration would be prohibitive compared to the costs of litigation, you may submit a written request to us explaining your financial situation, and we will consider in good faith whether to: (i) pay a portion of the arbitration fees; (ii) agree to small claims court; or (iii) agree to an alternative low-cost dispute resolution procedure.
(c) Arbitrator Fees. Unless the arbitrator determines otherwise, arbitrator fees and administrative costs shall be split equally between the parties for claims over $10,000. For claims under $10,000, the arbitrator may allocate fees as they deem equitable.
3.6 Opt-Out Right
You may opt out of this arbitration provision by sending written notice of your decision to opt out to admin@3dprintingandmodeling.com within thirty (30) days of your first use of this Website. Your notice must include your name, mailing address, and a clear statement that you wish to opt out of arbitration. If you opt out, all other provisions of these Terms will continue to apply.
3.7 Severability of Arbitration Provision
If any portion of this arbitration provision is found to be unenforceable, the remaining provisions shall remain in full force and effect. However, if the class action waiver is found unenforceable in a case where class relief has been sought, the entire arbitration provision shall be null and void with respect to that case, and the dispute shall proceed in court subject to the venue provisions below.
4. GOVERNING LAW AND EXCLUSIVE VENUE
These Terms and any Disputes arising out of or relating to these Terms or this Website shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of laws principles.
For any claims not subject to arbitration, or if arbitration is found unenforceable, you agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Allegheny County, Pennsylvania and you hereby consent to the personal jurisdiction and venue of such courts.
